Living Trusts

A Revocable Living Trust is the foundation of your estate plan. 

​It sets forth your wishes and instructions if you become incapacitated, as well as distribution of your assets upon your death.
  • It insures that your desires are carried out without unnecessary judicial involvement.
  • Can provide important instructions for special needs, incapacitated, or underage kids for educational needs.

Power of Attorney

This document appoints an agent to act for you if you become incapacitated.  
  • Your agent is authorized to transfer property to your Living Trust, to make withdrawals and/or necessary business and financial decisions if you become incapacitated.  
  • The Power of Attorney also contains a nomination of a conservator of your estate if you become incapacitated.

Real Property Deeds & Quitclaim Deed

After execution of your Living Trust, a Quitclaim Deed effectively transfers your real property into the name of your Trust.  
  • I can prepare Grant Deed(s) to change title of your property from/to Joint Tenancy, Tenants in Common, or Community Property.

Simple Wills - Pour Over Wills

If you do not own real property and have minimal personal property, a simple Will may suffice.  
  • A Will allows you to appoint guardian(s) of your minor children. 
  • A Pour Over Will created in conjunction with your Trust "pours" any assets that were not transferred to your Trust, or any subsequent acquired assets, into your Revocable Living Trust.
  • Your Pour Over Will functions as a safety net to ensure any future acquired assets be managed by your Trustee.  

Advanced Health Care Directive

Your Advance Health Care Directive authorizes your agent to make medical decisions for you if you cannot communicate or make decisions yourself.  
  • ​Emergency Notary on-site visits are available 
  • 5-Wishes® Healthcare Directive, allowing you to state your wishes regarding artificial prolongation of life.​

Amendment to Trust

If you wish to make changes to your original Living Trust, such as:
  • changing family information, i.e birth or death of a beneficiary
  • replacing a named Trustee/Successor Trustee
  • removing a named beneficiary
  • change distribution amount(s) or percentages of a beneficiary
A simple cost-effective Amendment to Trust may be your solution.
